This privacy policy – the “Personal Data Protection Policy” – constitutes a statement of principles and guidelines regarding the protection of the personal information of individuals who are our customers, our service providers and other individuals – “you” – other than our staff, whose personal information is collected, used and disclosed in accordance with our Staff Privacy Policy. CONSENT: Subject to legal and contractual requirements, you may refuse or withdraw your consent for certain purposes at any time by contacting us. If you refuse or withdraw your consent, we may be unable to provide or continue to provide you with certain services or information that may be useful to you.

This personal data protection policy applies to the collection, use and communication by us of personal information concerning customers who have subscribed to our services. The data controller, in accordance with the Tunisian law in force on the protection of personal data, is designated under the name SMOFT ERP (also represented by the terms “SMOFT”, “we”, or “us”).
SMOFT ERP are responsible for the proper functioning of the processing of personal data, in compliance with its confidentiality policy and the legislation applicable in Tunisia, on the protection of personal data. The solutions provided by SMOFT ERP (including training in the use of its solutions and Remote Assistance “the hotline”) will be referred to as “services”.
Tunisian legislation on the protection of personal data via the National Authority for the Protection of Personal Data – the INPDP, defines personal information quite generally as information concerning an “identifiable individual” or as information allowing identification an individual. The types of personal information that we may collect from you from time to time include: your last name, your first name, your position, the sector of activity in which you work, your physical address, your telephone contact details, your email address electronic, your title, payment information (for billing purposes), your service preferences, etc. In addition, from time to time, we sometimes ask our customers to complete opinion surveys / satisfaction questionnaires in order to know them better and serve them, and ask them about solutions and/or services that may interest them. Finally, from time to time, we may also acquire demographic and other information about you (e.g., your geographic location, gender and age).
We collect your personal information for the purposes indicated below :

In order to provide the solution, service or information that you have requested If you are a “customer” subscriber to one of our services, we use your name and address (email address) to validate that you have obtained the solution. , the service or information you requested and to follow up on the transaction (i.e. validate your account, send you an invoice, notify you of the expiration of your subscription, etc.).

We may share your personal information with the following third parties in the circumstances set out below:

Disclosures to Service Providers We may share your personal information with other companies that provide services on our behalf, including contracted fulfillment agents, auditors, our software developers (including developers, administrators and hosts of our website), and providers of data processing, document management and office services. In addition, we may share your personal information with an organization or individual retained by SMOFT ERP to assess your creditworthiness or collect outstanding debts on an account, or with our auditors. We will only provide these companies with the information they need to provide the service and they are prohibited from using the information for any other purpose.
. Communication to our business units We may communicate your personal information to any of the business units that are part of our Startup SMOFT ERP in order to better serve you, and to provide you with information regarding our company's solutions and services.
. Communication in the context of business transfers Smoft Erp may participate in the sale or transfer of part or all of its business. As part of this sale or transfer, Smoft Erp may communicate your personal information to the acquiring entity, but will require the latter to agree to protect the confidentiality of your personal information, in a manner consistent with this personal data confidentiality protection policy.

Law Enforcement and Disclosure Under Law Smoft Erp may disclose your personal information to a government agency that has asserted its lawful authority to obtain the information, or where Smoft Erp has reasonable grounds to believe that the information may be useful in the investigation of unlawful activity, or to comply with a subpoena, warrant or order of a court, person or agency of competent jurisdiction requiring the production of the information, or to comply with a court order regarding the production of intelligence records. Smoft Erp may also disclose your personal information to its legal counsel.
Smoft Erp wants you to be able to maintain control over how we use your personal information. In particular:
You may have the right to opt out of some or all of the specified purposes, uses and communications set out in Sections 3 and 4 above.
You always have the choice to ask us not to use your name, physical address, email address, telephone contact information, etc. and to only provide you with the product, service or information you have requested.

Your personal information is stored in secure locations as well as in servers controlled by Smoft Erp located either in our offices or in the offices of our service providers whether they are located in Tunisia or abroad.

Only authorized employees and suppliers have access to your personal information. When personal information is sent to a third party for processing, we ensure, through contractual agreements with them, that your personal information remains secure.
We retain your personal information for the period in which we provide you with a solution or service and for a reasonable period thereafter, in the event that you wish to obtain a service again. We operate secure data networks (encrypted information) protected by firewall and password protection systems corresponding to industry standards.
Smoft Erp sometimes collects personal information through its various tools.

Cookies – When an individual accesses Smoft Erp websites, we may use a browser feature also called a “cookie” to collect information such as the type of Internet browser and operating system the visitor is using, the domain name of the websites from which the visitor came, the date and duration of the visit, the number of visits, the average time spent on our websites, the pages viewed and the number of “cookies” accumulated. A cookie is a small text file containing a unique identification number that identifies the visitor’s browser (but does not necessarily identify the visitor) to our computers each time our website is visited. Unless the visitor specifically informs us (e.g., by subscribing to our solutions and/or registering for our services or by sending us a message from our website), we will not know the identity of visitors. In addition to the specific purposes described in our Privacy Policy, we may use this information from our website and share it with other organizations with whom we have business relationships, to measure the use of our websites and to improve their functionality and content.

However, when a visitor refuses cookies, they may not be able to use some of the features offered on our website. Online Communications – In order to subscribe to a solution, service and/or receive/enjoy information, visitors to our website may voluntarily provide us with personal information for purposes such as questions, requests for information, signing up for a trial of our free version, subscribing to a solution, service, viewing or downloading a document, participating in questionnaires and surveys. If Smoft Erp has identified you as a registered user of an online service, we may combine and store personal information about your use of our website and the online information you have provided with certain other online and offline information we may have collected. Email Communications – From time to time, we may send you marketing-related or promotional informational emails containing information that may be useful to you, including information regarding solutions, services, and updates related to our services and solutions. We will include instructions on how to unsubscribe if you decide that you do not want to receive marketing, promotional, or informational emails from Smoft Erp in the future.
In addition, if you send us a message by email, we may retain that message and your email address, as well as any response we send you. Opinion surveys and/or satisfaction questionnaires – Opinion surveys and/or satisfaction questionnaires conducted or transmitted from our website are anonymous. We do not establish a connection between the votes expressed in these surveys and the names or email addresses of the senders of the responses, unless this is indicated at the time of collection. Advertising to minors and/or children – Smoft Erp websites are NOT directed and in no way, to minors and children under the age of 18.
